WALHI meluncurkan seruan terbuka dalam bentuk MAKLUMAT Pulihkan Indonesia sebagai panggilan kepada rakyat Indonesia merespon situasi meningkatnya kekerasan dan pelanggaran atas lingkungan yang dilakukan oleh penyelenggara negara. Satrio Manggala Manager Kajian Hukum & Kebijakan WALHI menjelaskan latar belakang sikap ini disuarakan, yakni merespon tindakan pengabaian negara terhadap sejumlah putusan pengadilan yang memenangkan perjuangan rakyat atas pengelolaan sumber daya alam dan pengelolaan lingkungan hidup yang lestari.
Pertama, pelemahan supremasi hukum. Pelemahan ini salah satunya dilakukan melalui pembajakan legislasi. Simak bagaimana setting pembajakan legislasi ini dimulai dengan revisi UU KPK. Pembajakan dilanjutkan dengan tetap mengesahkan UU Cipta Kerja (Omnibus Law) yang dinilai akan semakin meningkatkan perampasan wilayah kelola rakyat.
Kedua, peningkatan daya opresi penyelenggara Negara kepada Rakyat. Hal ini semakin massif terjadi dengan dibarengi tindak kekerasan dan kriminalisasi. WALHI mencatat sepanjang tahun 2021 sejumlah 53 (lima puluh tiga) orang telah menjadi korban kekerasan dan kriminalisasi. 10 (sepuluh) di antaranya adalah korban kriminalisasi Pasal 162 perubahan UU Minerba.
Ketiga, puncak dari tindakan penyelenggara Negara adalah pembangkangan terhadap Konstitusi. Penyelenggara Negara tidak tunduk atas Putusan MK No. 91/2021 tentang UU Cipta Kerja. Pada amar nomor 7 jelas memerintahkan kepada penyelenggara Negara untuk untuk menangguhkan segala tindakan/kebijakan yang bersifat strategis dan berdampak luas, serta tidak dibenarkan pula menerbitkan peraturan pelaksana baru yang berkaitan dengan Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja.
Maklumat juga disampaikan bersama 28 (dua puluh delapan) kantor daerah yang sedang menghadapi situasi tekanan yang beragam. Mulai dari tindakan kekerasan aparat, kriminalisasi pejuang agraria hingga meluasnya bencana ekologis. Dengan membentuk pos koordinasi dan membuka ruang-ruang konsolidasi di seluruh daerah.
